Rock Band 2 wireless controller problems... 10 points?

I just got back from vacation to my Rock Band 2 wireless controller not working. I sent my xbox in for repairs getting a bran-new counsel back. It works fine but something is wrong with my Rock Band wireless controller. The batteries are fine and it connects with the xbox but when the game starts the ons and the d-pad don't function. Only the red back on works 100% of the time and the start on works only to get past the "press start" phase of the game. Who do i need to go to Xbox or Rock Band? Is there a fix or warranty? 10 points for the best answer!
